Have you ever been in a position that you had to decide if your kids got new school clothes or your truck got insured? I bet not. Ever had to give your parents a paycheck so that they could make the house payment that month? Didn't think so. When my dad was layed off a few years ago I was there, and I remember just what that felt like. Who am I to take this guy for what little money he makes? Will it make me a better person to line my pockets with someone elses change while he goes bankrupt? No, it won't.

Actually I do ride, in one of the worst driving states in the country at that. Way to make yourself look ignorant. You place way to much faith in people, do you know this guy's background? Did he call you or meet you to apologize and explain why he decided to run a red light or not have insurance? Taking him for all he's worth would hopefully show him and others that driving wrecklessly and/or not having insurance is not acceptable. Hopefully he won't kill his next victim because you've done nothing to stop his behavior. -1 for overall humanity

He was in the hospital when I came out. He thought that he had killed me, and that he didnt even see the bike until it was too late. He lives about a block north of my brothers shop in Omaha. You don't have to ruin someone's future just to make a point and make sure they know what they did was wrong. Ever make a mistake? Oh, I forgot your a model ****ing citizen. Im sure you have never done anything wrong. Im not going to pay anything out of pocket, and my insurance company is going to take care of the money they had to pay. Why do I need to garnish wages from this guy for the next 20 years? How is that going to make me better off? I have money. My brother knows the guy, not well, but knows who he is. He can't afford insurance and the public transportation here is not good enough to go without a car in the city.

I'm sure there are a lot of people out there that thought the same as you, and then down the road realized that they would be in pain the rest of their life without compensation. I hope you're not one of those people.
Yep...plenty of medical complications won't show themselves for up to years into the future. I was hit while riding a Vespa by a driver riding in the median. I already have complications that will worsen with time. I was told I'd never walk again, and then told I'd never play sports again. I've gotten back to where I can, but still have residual pain and aches from the accident. I am guaranteed to have hip problems in the future.
I sued his insurance company and got a large settlement. Hopefully it will cover my future medical costs. If he hadn't had insurance, I would have sued him personally.
Then when your medical bills start coming in I'm sure you'll sing a different tune.
It does NOT show a lack of humanity to want to be compensated for future costs. It shows your naivete and misplaced idealism. As 1337 said, it is a privilege to drive. Can't afford insurance? DONT DRIVE. Get a freakin bike or get an apt. near your place of work. And after all that you are still going to drive, obey the rules of the road why dont you!?!?
I think that's what you guys have to consider though. He's OK. If he had gotten seriously hurt physically, or suffered from PTSD, like a lot of people who have these kinds of accidents do, then he would probably be more inclined to sue.

But it's just the whole, future problems thing. I was in a minor car wreck. Got rear-ended at a dead stop and the lady was going about 40mph. Severe whiplash. Went to a chiropractor for months but to this day I still get back/neck pain pretty easily. No, it's not everyday pain, but before the accident it never really bothered me at all.
I didn't sue for future compensation, which I wish I would have now. All I got was the cost of repairs and my medical bills covered. Luckily I pocketed quite a bit of it though. Hell that accident bought my motorcycle.
