anything in the car is considered the responsibility of the person who owns the car. If you're driving and sober and people in the car are stoned, you're basically cool- the dsignated driver rule. Rules vary from state to state.

Don't depend on this, but i'm pretty sure this is how it is. PM me for a great site concerning this type of thing.

Last time I checked weed was illegal unless you had that medical card. I first reading ur post i thought u meant as long as theirs a designated driver ur cool, like drinking. lol

All of you.

A B and C are in a car.

I'm person C. Person A is driving the car (when needed), and person B is murdering an innocent bystander.

Person C is doing nothing.

Sitting in the seat is while people smoke is hardly facilitating a crime, it seems to me like guilt by association.

He said that person B was smoking, not smoking and killing somebody. I would guess that you should be fine, if it's like the scenario that you said but your two friends, could be in some trouble. I don't know though, b/c when I was coming up with that I was basing it off of what sounds reasonable to me, not the laws.....

It's the same concept. You aren't doing anything to prevent the crime from happening, so you are guilty by association.

Its not illegal to not prevent a crime, as long as you aren't facilitating it.

Proof. If this is the truth, then police have arrested me on false charges.

Actually, now that you mention it, I never have seen concrete examples in penal law of this... so you tell your story and I'll look some stuff up.

Same predicament you question now. Buddy of mine had weed, he and my other friend were smoking, I wasn't (I don't smoke weed). I got arrested along with them on some BS charge. I don't even remember what he told me he was taking me for.
