Dye Sues SmartParts
Yesterday, April 8, 2005 Dye claim's SP is violating there patent's.
"Dye has filed suit against Smart Parts (shop | news), claiming that Smart Parts "willfully, deliberately, and intentionally" violated Dye patents, and continues to do so with other developments.
Specifically, the suit references the Ion, Shocker, private label Shockers, SFT bolt kits, and charges that Smart Parts (shop | news) is "inducing others" and providing instructions to violate Dye's patent.
The court document claims Dye as been "irreparably damaged" and calls on the judge to award lost revenue, damages, and court fees to Dye, as a result of Smart Part's alleged patent violations.
Dye has hired the largest patent & intellectual property law firm on the West Coast to handle the case, and is demanding a trial by jury.
Other than the court filing, both manufacturers are tight lipped about the allegations, so we'll have to wait and see what happens in court. "

hmm...i don't know how all of this would be infringing on dye's patents...but, wasn't the matrix supposed to operate similar to the shocker???

The matrix come out a long while before the shocker. But yes they are both spool valves. SP got the rights from dye to use a similiar design for the shocker. Now, Dye is being hypocritical and suing SP.

im pretty shure all sports go threw this with the sueing, we just dont hear about it because its not news people report on.

mna, this is getting out of hand. How can SP be infringing on a Dye patent on the shocker/ion/etc when they were infringing on WDP patents for the same stuff? does that mean Dye should also sue WDP? this is so stupid. All the leaders of these companies should go jump off a cliff, or stop suing each other.

i agree totally with that, like every other damn sport, it's becoming more about the money and power and less about getting good products out so people can have fun. and technically, can't the first paintball gun manufacturer sue everyone for the somewhat same design? i mean that as a joke, but it might just happen.
here's a quick question: how many companies make stacked-tube blowbacks?
how many are sueing each other?

can you people please stop saying things like "OMGZORZ, WHATS THE SPORT GETTING TO WHERE EVERYONE SUES EACH OTHER" fact is, that non of these companies care what happens to the sport, they are out there to make money, and when someone uses products which are theirs and gets money from it, they should be sued. This wont effect the sport, paintball is going to be any worse because dye sued smart parts, or smart parts sued 50 other companies... sure some guns are lost, and some companies are closed, but when you go out on the field and are playing, you dont think of smart parts, or dye, you're thinking of the sport, and of the end result, which is you playing paintball, happily.

i know that, each gun is a little different than every other one. what i am sayin is that it will eventually come down to that after they run out of things to sue each other over. you don't see any of that yet because they are goin for the big dogs (expensive, high end guns) and leaving the little ones alone. that's what i was trying to say
edit: and for the record, i hope the courts will throw this case out the window, and tell them to get over it. they won't, though.

All stacked tube-blowbacks are the same. Spring returns hammer, hammer moves bolt, blah blah. The only reason is it's such a obvious patent/idea. And the micro-switch battle...comeon that should of never been allowed to even START. What else are u going to use to communicate w/ the board? Somethings are just to obvious for a patent, a patent is for a specific idea, and serves to pretect the idea. Not to make some money off others like sp did w/ the micro-switch. And i think WDP's whole board battle w/ sp was a little payback, though i consider it dumb also.

The patent on Stacked-Tube Blowbacks expired.. awhile now..
The reason SPs patents lasted so long was that they were always "pending" and lasted for awhile. Need to find that article that says this.

no their not becoming greedy little female dogs their just using their business rights and playing it smart. If i were a business and someone was violating my patents without proper pay then i would get pissed and start suing people too. Inventions are hard to come by and if someone is using it without proper compensation then theirs really no point in inventing something.
