k i dont know if this should go to tourney talk or w/e

k i have a field at my house and want to have a tourney....... but my dad said i need a waver can someone like send me one from a field near them and i can just edit it or something

RELEASE AND AGREEMENT

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the undersigned, the undersigned hereby agrees as follows:

A)I am at least 18 years of age and in good mental and physical health.

B)I am aware that S.A.R. Inc. trading as AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES is a physically and mentally strenuous game involving possible risk of injury to me and others, from equipment, other players and the playing environment, and I declare that I am physically fit and mentally able to take the strain of exertion involved in this game.

C)I undertake to play the AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES only in accordance with the safety instructions, rules and guidelines as set out by AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES and the laws of Canada.

D)I am aware that AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES does not warrant the condition or safety of equipment, facilities or premises connected with the AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES.

E)I on behalf of myself, my estate, heirs, executors, administrators and assigns do hereby indemnify the equipment manufacturers and suppliers, the land owner, and their respective directors, officers, agents, and employees, from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities whatsoever connected with or resulting from playing AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES, and/or use of equipment and premises whether resulting from negligence of any party or otherwise. I hereby further agree to indemnify the same said parties on behalf of my estate, heirs, executors, administrators and successors, from any and all claims that I may have against the said parties and from any other player in the game who might mistake or otherwise injure me.

F)I accept full responsibility for return of all equipment in good condition or replacement value upon termination of the day's play.

G)I have read carefully and agree to the SAFETY INSTRUCTIONS and RULES of AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES as may be established by it's agents, including those set down below, and I will comply with all rules of the game and use the equipment so as not to injure or hurt other players, and I will comply with all the rules set by game referees, and I agree that my right to play the game and to use the equipment may be terminated without refund if I fail to follow such SAFETY INSTRUCTIONS and RULES.

H) I consent to the free use of my photograph or other recorded image or sound reproduction in any future promotional or advertising material in such form and at such times as the AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES promoters may in their sole discretion determine, and I hereby waive any claim for compensation in respect of such use.

I)I have read and fully understand this RELEASE and AGREEMENT and recognize that it is legally binding.


SAFETY INSTRUCTIONS AND RULES

1)GOGGLES SHALL BE WORN AT ALL TIMES WHEN ONE IS ON OR NEAR THE PLAYING FIELD, OR WHEN USING THE FIRING RANGE.

2) FIRING AT OR NEAR ANY PERSON NOT WEARING GOGGLES IS STRICTLY PROHIBITED.

3)A WEAPON SHALL NOT BE POINTED AT OR NEAR ANY PERSON EXCEPT DURING AN ATTEMPT TO SHOOT IN THE COURSE OF A GAME, NOR SHALL A WEAPON BE POINTED AT ANY NON PLAYER OR INTRUDER AT ANY TIME, WHETHER ON OR OFF THE FIELD.

4) PARTICIPANTS SHALL ATTEMPT TO AVOID AIMING AT OR SHOOTING AT THE HEAD OR FACE OF ANY PLAYER.

5)FIRING OUTSIDE THE PLAYING FIELD, OR INSIDE THE DESIGNATED NEUTRAL ZONE IS STRICTLY PROHIBITED.

6) PARTICIPANTS SHALL STAY WITHIN THE BOUNDARY OF THE AMBUSH - TACTICAL OUTDOOR PAINTBALL GAMES PLAYING FIELD. NO PARTICIPANT SHALL PLAY OR MOVE OUTSIDE THE PLAYING FIELD BOUNDARY WHILE CARRYING A WEAPON.

7)WEAPONS SHALL ALWAYS BE CARRIED/POINTED IN A SAFE DIRECTION UNLESS THE PLAYER IS AIMING OR SHOOTING IN THE COURSE OF A GAME. WHEN AT REST, WEAPONS SHALL BE SET ON SAFETY AND PLACED POINTING IN A SAFE DIRECTION.

You have to have insurance to hold a tournment. I know if i was going to play i wouldn't play on an uninsured field.

a waiver wont do **** if you dont have insurance. And to get insurance your need to spend hella money on safety equipment(ie: metal netting)

1) IF you are sponsoring a tourney on a home field, check to see if your father's homeowner's insurance will covery your basic liability. Otherwise, if someone were injured at your event, you may be held liable.

2) Liabilty waivers are basically worthless. They will certainly help to demonstrate in court that you attempted to educate your participants that there are risks in the event blah blah blah, however it will not absolve you of any negligent acts by you, your family or your staff. Plus it will cost tons of bucks to defend such actions in court regardless of the waiver or not.

If you advertise and charge admission you will be under a different set of liability laws as opposed to general liability of a homeowner. You will need to have a Commercial liabilty policy.

Also, if you are charging admission and giving out prizes, you may be in violation of your local zoning laws. If you are zoned for residential or even farm, then you will need to apply for a zoning varience to operate a commercial venture (your field) off of your property.

Am I trying to get you to not have your tourney, absolutely not. But I don't want to see you on People's Court either defending against huge damages.
