Yup mail fraud yup a little definition I hope this doesn't sound like an attourney wrote it I'm taking criminal justice in college .
The Mail Fraud Statute (Title 18, United States Code, Section 1341) is the nation's oldest federal consumer protection statute and effectively fights white-collar fraud and product and service misrepresentation (the key word in this circumstance). It defines fraud as a scheme or artifice which uses the U.S. Mail to obtain money or property by means of false or fraudulent representations.
Mail fraud is a criminal scheme where the postal system is used to obtain money or anything of value from a victim by offering a product, service, or investment opportunity that does not live up to its claims (the paintball marker). To obtain a mail fraud conviction, a prosecutor must prove (1) the facts surrounding the offer were intentionally misrepresented (the e-mails communicated throughout the process) and (2) the U.S. Mail was relied on to carry out the scheme (its obvious how to prove this).
I hope if you don't persue this further that you've learned a lesson you've got to be more careful on risky transactions like these while this may be some stupid kid that thinks theres nothing you can do about it and doesn't know the consequences he can face.

As much as I feel sorry for you man, you really can do anything. He ripped you off, cheated you, but there was no fraud policy as that related to ebay. Because you didn't make a fraud policy, and have him hand sign it or, you weren't part of a website that had a fraud policy when buying/selling/trading, you can't do anything about it. He can't get arrested for what he did, even though it was wrong. Sorry man, keep this as a lesson, don't trust people that you don't know, take extra precausions. Sorry man.
However, if you can find someone who recorded the phone call, (Phone Company), about a verbal agreement, then you can take him to court to get it back. The phone company (Different Ones) sometimes record something when a word triggers it, something like "bomb" or something, and sometimes they record phone calls to keep records on everyone. (They don't always listen to them, but store them) and I am sure you can call you phone company and give it a shot.
if you cant do anythign to him or to get your gun back, your stuck with the angel, which is not that bad at all, all it needs is fix ups, whats the price range we're looking at around here?

ok you have his name address and user name. if you lost his adress his IP can be traced or his Phone can be traced. Try calling him again and tell him you'll take legal action. A verbal agreement doesnt have to be recorded. Im pretty sure if you take him to court the judge isnt going to think you wanted a broken gun. .......that or you could tell us where he is and one of us closest to him could go "talk" to him.
